Sebastian police arrest man they claim had gun at bank
SEBASTIAN � Bank tellers were alarmed Wednesday when a customer requesting a sizeable withdrawal showed a gun in his belt and made a threat, Sebastian police said.

Jay Z. Hugh, 57 of the 500 block of Melrose Lane, Sebastian, was charged with aggravated assault and booked into the Indian River County Jail, said police spokesman Officer Steve Marcinik.

Police ordered a discreet evacuation of National City Bank on County Road 512 west of Barber Street about noon Wednesday after bank tellers contacted authorities. Detectives also went to Hugh�s home and removed nine rifles and six handguns at the request of his wife, Marcinik said.

�His wife told us she�s not afraid of him, but he had been talking about Doomsday in recent days,� Marcinik said. �She said she felt more comfortable with the guns out of the home.�

Police said Hugh went to the bank and asked for a withdrawal of several thousand dollars in cash. Bank tellers told investigators they advised Hugh that it would be a large amount of cash to carry around and asked if he would prefer a bank check. In response, Hugh showed the tellers his gun and said he wasn�t concerned about carrying around the cash, police said.

�He also made a comment to the teller that �you should be scared,�� Marcinik said.

A bank manager sat with Hugh in the lobby of the bank while seven employees and a few customers quietly evacuated the building, Marcinik said. Officers entered the bank through an employee entrance and took Hugh into custody.

Bank employees told police they recognized Hugh as a regular customer.

A stupid comment and some stupid bravado, but not a threat.

A simple "thanks for your concern, but I prefer cash" is all he had to say.

Local, a couple weeks back:

On 06/05/09, at approximately 7:00 p.m., a suspect was at 60th AV SW and Alki Av SW with a female friend, when he got into a confrontation with a group of juveniles (young teenagers — middle school students). The suspect hurled profanities at the teens and pulled up his shirt to display a holstered handgun, frightening the juveniles and many onlookers. Officers arrived on scene and quickly located the suspect at Alki & 63rd SW. Officers recovered a .357 magnum revolver from the suspect’s waistband. He appeared to be under the influence of alcohol, and was also carrying a flask of whiskey. The suspect, produced a US Army ID, identifying him as an active duty sergeant, and a CCW permit issued by the state of Ohio.

After interviewing victims and witnesses, it was determined that the display of the handgun did not appear reasonable in response to any real or perceived threats from the juveniles. The suspect was arrested without incident and transported the Southwest Precinct. The suspect’s immediate commanding officer was contacted and made aware of the situation. The suspect was booked into King County Jail for unlawful carrying/display of a weapon. The revolver and Ohio CCW card were placed into evidence.

OP hit the nail on the head - never forget the "concealed" part of "concealed carry." In fact, my state has a quick-reference list it sends you with your permit, and one of the biggies is that you never show the weapon (unless you need to use it).

His comment didn't help, either. While I'm pretty sure he was saying the teller should be afraid of the future, it was definitely a poor choice of words, especially after mistake #1 above. The guy could be aware and rational like most of us here, but those two bonehead moves cast that shadow of doubt upon his mental state.

Still, this just goes to show you how the general public really hasn't awakened yet. Despite all the fuss about the right to bear arms and the fear of what Obama and his gang might do to the 2nd Amendment, the general consensus is still that anyone who carries a gun around with them is "dangerous."

But I think the wife's attitude is even more telling. I can feel for him. Most of us here realize that we're possibly only one event away from a total breakdown of social order - as has been said before, Katrina on a national scale. And many of us have lamented about the spouses not being on board. Like this guy, I've been accused of being a whacko, as my spouse thinks water will always come out of the faucet, electricity will always come out of the outlets, food will always be on the shelves at the supermarket, and people who have no job, no money and no food will wait patiently for Obama and FEMA to come help them out. She's okay with the PMs, but any steps to prepare for when the above things don't happen (or TSHTF) are just a waste of time and money. :banghead:

Open carry is LEGAL in the majority of states: www.opencarry.org

It's not legal in any state to threaten someone while carrying, either openly or concealed.

That flys in the face of the 1st and 2nd ammendment and it's a sad day when gun grabbers can pressure gun owners in to condeming their own for violations of the unwritten truce of public relations.

Why even resist gun grabbers if we tie our own hands in fear of them?

Thankfully Tennessee doesn't care whether the handgun is openly carried or "concealed"...

Our permits are "Carry Permits", not "Concealed Carry Permits"...

Addsing the word "concealed" simply gives Law Enforcement another untraceable way to arrest or detain you for violating this law...

North Carolina law expressly prohibits carrying in banks or any financial institution, with or without a permit. FWIW.

What bothers me about the story is that really we have no way of knowing if the wife truly expressed the wishes attributed to her by the LEOs, nor under what state of duress she was at the time. It does make for a "neat and tidy" story with her wanting the weapons out of the house. Who knows how it really went down.

Learn the law -- OPEN CARRY IS LEGAL IN N.C. BANKS. It is only concealed carry that is prohibited in N.C. banks.

SEBASTIAN � A man accused of displaying his gun to bank tellers when he tried to make a withdrawal posted $15,000 bail at the Indian River County Jail Thursday.

Hugh Jay Zaplin, 57, of the 500 block of Melrose Lane, was charged with aggravated assault with a deadly weapon and improper display of a firearm. Sebastian police took him into custody following the incident at National City Bank in the 900 block of Sebastian Boulevard Wednesday.

According to an arrest affidavit, Zaplin wanted a withdrawal of $93,000 cash from his account. Bank staff advised him he may want cashier�s checks instead, the report said. In response, Zaplin lifted his shirt to display a black revolver in his belt and said �Don�t worry. I have my attorney on speed dial.� Zaplin also later made a threatening comment to the bank manager and brandished the revolver, which police said was fully loaded.

Bank staff called police and led a discreet evacuation of the bank while a manager sat and talked with Zaplin, police said.

Police spokesman Steve Marcinik said Zaplin has a permit to carry a weapon and the bank does not have a sign prohibiting anyone from carrying a weapon in the building. However, Zaplin�s comments to the tellers led to the assault and exhibition charges being filed against him, Marcinik said.

The 2nd part of the story with the cops stealing his weapons at the request of
his wife is not sitting well with me. Is it legal for the police to grab the weapons of a
private citizen at the request of someone else (spouse or not) ?

"Brandished" the weapon gives the impression he pulled it out and waved it around.

Careless use of words if he never pulled it out...but I suspect that was the intent of using that word....

Lol. I didn't read that right the first time. This guy should have had a posse in a jeep with AKs for that type of money. Then again: loose lips sink ships. It's a catch 22 cause the teller can squeel but so can the "posse." Maybe by himself is better?

His wife should know better than to talk to the cops about him. Didn't he teach her anything?

We don't know that he threatened the teller, I think she made that part up to give more credibility to her argument that he was a dangerous threat.

COP: So what did the man do?
TELLER: He showed me the gun on his hip.

True here in Ohio too, no carry in banks, hospitals, churches, (unless allowed by the church), or any location that prohibits concealed carry by posting a sign in plain sight at any point of entry.

True also that not only was the guy terminally dumb, but so was his wife. :confused_ma: As in, I believe my wife feels safer knowing that there are weapons in the house and someone who is trained to use them correctly and when that appropriate time would be.

"Brandish" in terms of a lot of gun laws means to basically make a motion that would indicate that you have a gun and are willing to use it (threatening the person you're interacting with.)

Example, if you were to reach for a holstered gun, grab the butt, but not actually pull the gun out, it could be considered "brandishing". Or gangster style, if you lifted your shirt to expose the butt of a gun tucked into your shorts as you shout "back up b4 I drop a cap in your ass!" you're brandishing... Examples for all audiences! ;)

I bet that quote was reported out of context. The media does this all the time. Look at the capitalization and punctuation of the quote. It looks as if he said more than just, "You should be scared."

It probably went something like this...

Customer with self-defense protection: "The economy is getting real bad."

Teller: "Yeah, some customers are worried becuase they read about other banks closing.

Customer with self-defense protection: Well, you should be scared, this is gonna make the great depression look like a cake walk.

And then the media/police only report the, "you should be scared" part. Is there any evidence this guy vilolated anyone's rights or attempted to do harm to anyone? God forbid anyone be presumed innocent until proven otherwise. Oh no, wait, we wouldn't want to inconvenience the the government.

I went to a new local bank while back to open an account for a small CD...the branch manager was a woman who took me in her office to fill out the paperwork. When it came to ID time, I flipped open my wallet where my driver license and my carry permit are on facing folds of the wallet under a plastic window. She smiled, and said "Got your permit too, I see.....what are you carrying ? " I replied a Glock 19.....she said "Mine is a Smith and Wesson hammerless" and proceeded to show me !

Seems she got robbed at gunpoint years ago when she was a teller and she said the only thing she could think of at the time was about leaving her kids orphans.....and from then on, she carried.

Jay Z. Hugh, 57 ...... Amazing! Two rhetorical questions: How can a 57 year old guy get this far along in life without mishaps like this derailing him? Why could he not have exercised his right to remain silent before he entered the bank? Amazing!

I have shown mine several times to people, but I ask them if they woul dlike to see it first, and I do not show them out in front of a crowd. I think at that point you are not "brandishing", but I am not sure how the FL court would interpret.
